Hawaii recognizes both pre-marital agreements (prenups) and post-marital agreements. In essence, these are contracts between a couple whereby they agree how assets and debts will be divided in the event of a divorce. Many things can be addressed in a marital agreement and can help to put the couple's mind at ease in the event relations go south.
These agreements can be extremely useful in protecting particular assets that a person brings into a relationship. Examples of things that may be protected are:
- Retirement accounts
- Investments
- Family heirlooms
- Anticipated inheritance
It is important, that when deciding to enter into a marital agreement, the parties are completely open and honest with each other about their financial situation, both with assets and debts.
